The bizarre attack comes just weeks after a man in DC was banned from smoking medicinal marijuana in his home after a neighbour sued him being a nuisance' and 'disrupting her health,' - despite being legalised in the city.
The court ruled in favour of Josefa Ippolito-Shepherd, 75, against her neighbour, Thomas Cackett, 73, after Ippolito-Shepherd raised a lawsuit claiming that the smell of smoke coming from the neighbour's apartment prevented her from sleeping, which negatively affected her health.

Despite Thomas having a full prescription and resides in a city where both medicinal marijuana and recreational dispensaries are legal, the judge, Ebony Scott, decided that he “does not possess a license to disrupt the full use and enjoyment of one’s land.”
The judge wrote in her decision: "Indeed, the public interest is best served by eliminating the smoking nuisance and the toxins that it deposits into the air, toxins that involuntary smokers have no choice but to inhale."
